1. Scope
These general terms and conditions of use (hereinafter “General Conditions”) govern the offer and provision of Services.
Booking of Services is reserved exclusively for Users who have previously read the General Conditions in their entirety and accepted them by checking the box or clicking on the provided hyperlink. Without this acceptance, continuation of the booking process is technically impossible.
Consequently, finalizing the booking process on the Site constitutes the User’s express acceptance of these General Conditions. Also applicable to the offer and provision of Services, under identical terms to the General Conditions, are the specific conditions of the Partners (hereinafter the “Specific Conditions”). The User’s acceptance of the Specific Conditions occurs at the time of the actual booking.
The General Conditions may be modified at any time, without notice, it being understood that such modifications will not apply to Services bookings made previously. Therefore, it is imperative that the User consults and accepts the General Conditions at the time of making their booking, in particular to ensure awareness of the provisions in force.
2. Order
2.1 These Sales Conditions apply to any booking of a stay made by a non-professional traveler with Toubana Hotel & Spa. By Order, we mean any booking request submitted by the Client whose availability is confirmed by Toubana Hotel & Spa. An Order is governed by the Sales Conditions in force on the day of the booking request. Depending on the type of services sold, specific conditions may apply.
2.2 The Client acknowledges having the capacity to contract under the conditions described in the Sales Conditions presented herein, that is to say, being of legal age and not under guardianship or curatorship. These conditions are an integral part of the sales contract.
2.3 The Client acknowledges having read these Sales Conditions in their entirety, the specific conditions particular to certain services, as well as all the terms of the proposal before placing their Order. Therefore, any booking request entails the Client’s full adherence to Toubana Hotel & Spa’s Sales Conditions.
3. Rates
Prices are indicated in Euros. VAT is always included. The prices indicated only include the services strictly mentioned in the booking. To the price mentioned in the booking, additional services provided by the hotel during the stay and, where applicable, the tourist tax will be added at billing. Prices indicated on communication media (website, flyers, etc.) are subject to change without notice, and only the price indicated in the booking confirmation is contractual.
4. Payment Methods
To validate and pay for their order, the Client has several payment methods:
Payment in 4 installments by credit card with our partner FLOA.
Our financial partner FLOA offers payment solutions for your purchases of goods and/or services, in 4 installments by credit card. These payment solutions are reserved for individuals (adult natural persons) residing in France, holders of a Visa or MasterCard credit card with a validity date corresponding to the duration of the repayment. FLOA, RCS Bordeaux 434 130 423, with its registered office at Immeuble G7 – 71 Rue Lucien Faure in Bordeaux (33300), is subject to the supervision of the Prudential Control and Resolution Authority (ACPR), 4 Place de Budapest, CS 92459, 75436 PARIS CEDEX 09 and is registered with ORIAS under the number 07 028 160 (www.orias.fr).
